EE license - photographer's portfolio

    Portfolio site of our client who is an artist and freelance photographer will have EE as a back-end. What license does he need if the site will include:

    A) photos that are both personal artistic pieces and professional work for clients (architecture, interiors, portraits); texts include artistic vision, bio, description of published books and contact info is provided, but no commercial overtones in copy and no B, C, D, E.
    B) a link to photographers blog on one of the popular blog hosting sites. The blog would have info about his services and book purchase details
    C) portfolio “Books” page includes “More details” link to the blog
    D) portfolio “Books” page includes “Buy books” link (PayPal)
    E) texts include description of photographers services

    Only photography pieces will be published on the site, although the artist provides broader creative services like print and web design.

    Two simple questions can help you determine what type of license you need.

    1. Is the primary purpose of the site to make money?

    2. Is the purpose of the site to support a legal business or professional service in any way?

    If you answer yes to either of the above then you need a Commercial license.

    So, for example, a non-profit taking donations, a personal site selling a t-shirt with the domain on it, etc… are all personal licenses. But a “brochure” style site about a business that doesn’t sell anything or display ads would still require a Commercial license since it supports a business.

    Since this site is to support his business of photography, a commercial license would be required.
