PHP error in 'Communicate' if there are no mailing lists

Hi,

I just deleted the default mailing list (client will only be sending to member groups - not lists) and get a PHP error in CP > Communicate

A PHP Error was encountered
Severity: Notice

Message: Undefined variable: mailing_lists

Filename: tools/communicate.php

Line Number: 55
```
Site upgraded to 2.5.2.

Looks like a bug?
