Are we allowed to use the same license for a “dev” instance of our site? In other words, we install a copy of every site on dev.domain.com and we actively work on the dev install and then we copy to the production domain after everything tests ok.
So can we consider a dev install as the same license?

Eric, Per our sales FAQ you can use the software for a production and 1 dev instance.
